A postnuptial or post-marital agreement is a contract signed by either spouse after marriage. This can be advantageous for spouses who wish to agree on issues surrounding property division, retirement benefits, support, etc. during the course of marriage.
If you are presented with such an agreement during marriage, it is important that you consult with an attorney that may advise you accordingly prior to signing the contract. Postnuptial or post-marital agreements are entered into between the spouses on a voluntary basis, and are never mandatory. Once signed, it becomes a binding and enforceable contract under the law.
